Terms of Service

What you get, what you pay, what happens if you stop — and what A11ytek Monitor can and cannot tell you.

What these terms cover

These terms apply to A11ytek Monitor and to the accessibility services A11ytek provides — audits, remediation, document work and training. By opening an account or accepting a quote, you agree to them.

A11ytek is the vendor of record. There is no third party on your contract or your invoice.

How we handle personal information is set out separately in our Privacy Policy.

The service

A11ytek Monitor is a managed service. We host it, and you sign in. The software itself is not supplied to you and the source code is not handed over, except under a separate self-hosted licence agreed in writing.

Each organisation's data is kept separate. One customer cannot see another customer's sites or results.

Plans

  • Free — one website, 25 pages, up to four scans a month, no card. It is capped rather than time-limited, so it does not quietly expire. The list of 25 pages can be changed once a month.
  • Basic, $29 a month or $290 a year — one website, 100 pages, ten scans a month.
  • Monitored, $240 a month or $2,400 a year — three websites, 300 pages, ten scans a month, plus time from a person who reads the results with you.
  • Managed, $600 a month or $6,000 a year — five websites, 750 pages, ten scans a month, with the reporting handled for you.

A page means one web address that gets tested on each scan. You choose which ones.

If we change a plan's price or its limits, we will tell existing customers first, and the change will not apply in the middle of a term you have already paid for.

Payment

Prices are in US dollars and exclude tax. Applicable taxes are added at checkout.

Card payments are handled by our payment processor. We never see or store your card number.

Public bodies can pay by purchase order. Send us your PO number and we will issue an invoice on net-30 terms, payable by cheque, EFT or card.

Yearly plans cost ten months instead of twelve. That discount is in exchange for the commitment.

Cancelling

  • Monthly plans — cancel any time. The service runs to the end of the month you have paid for.
  • Yearly plans — you can cancel, but the plan runs to the end of the term you paid for and unused months are not refunded. The yearly price is lower precisely because of that commitment.
  • If you stop paying — your account drops back to the free plan. Every report you have already paid for stays readable. Only new scans stop.

We can close an account that breaks the section below, and we would tell you why.

What you may ask us to test

You may only ask us to test websites that you own or are authorised to test. That is your responsibility, not ours.

The service must not be used to probe a site in order to attack it, to overload someone else's server, or for anything unlawful.

Our scanner reads public pages the way any visitor's browser would. It does not log in, submit forms, or change anything on your site.

What Monitor is — and what it is not

Automated testing finds roughly a third of WCAG problems. That is true of every automated tool, including ours.

Monitor cannot tell you whether your alt text means anything, whether your headings describe what follows, or whether a person can actually finish your online forms. Those need a human looking, which is separate work.

A good score is a good sign. It is not a certificate of compliance. Nothing in Monitor should be presented as legal advice, or as proof of conformance with the AODA, the ADA, Section 508 or any other law. Where you need a formal conformance report you can put in front of a regulator, ask us and we will quote for one.

Who owns what

Your data — the sites you list, the results and the reports — is yours. You can export it, and we will help if you need it out.

The Monitor software, its scanning configuration and its report designs remain ours.

Reports we produce for you are yours to use inside your organisation and to show to regulators, funders and the public.

Availability

We aim to keep the service running and scans on schedule. We do not offer a guaranteed uptime percentage, and you should not rely on one.

Scans can be delayed by queue length, by a site being slow, or by a site blocking our scanner. Some sites block it completely — where that happens we will tell you, rather than produce a report we cannot stand behind.

We may take the service down for maintenance, and will give notice where we can.

Liability

We provide the service carefully, but without warranties beyond those the law requires.

Where liability cannot be excluded, ours is limited to the amount you have paid us in the twelve months before the claim.

We are not liable for indirect losses — lost business, lost data you have not exported, or the consequences of a complaint or legal action brought against you.

Nothing here limits liability for anything that cannot lawfully be limited.

Confidentiality

We treat what we see of your systems and documents as confidential, and will not share it without your permission except where the law requires it.

We will not name you as a client publicly without asking you first.

Services other than Monitor

Audits, remediation, document work and training are quoted individually. The quote sets the scope, the price and the timing, and where it differs from these terms, the quote takes precedence.

Changes to these terms

We may update these terms. The date at the top changes, and for anything significant we will tell existing customers rather than quietly editing the page.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it.
